Civil Servants (PNS) to behave in a professional and impartial in carrying out its duties and responsibilities as a servant of the state. If a civil servant (PNS) a member of a political party, the Civil Servants (PNS) shall be dismissed from government agencies for which he worked and left attributes as a Civil Servant (PNS). Based on that, the need for regulation of the dismissal of Civil Servants (PNS), which became a member of a political party.

The research method chosen by the researchers is normative juridical method that aims to load completely legislation relating to the dismissal of Civil Servants (PNS) as a member of a political party and how the dismissal procedure. The data used in this study are primary data and secondary data. The primary data obtained through field interviews which can be done using interviews with the parties that have relevance to this thesis research. Secondary data are sourced directly from the legislation, literature books of jurisprudence and law magazine article and the articles that are related to the problems examined through library research.

Regulation on the prohibition of Civil Servants (PNS) become members of political parties regulated in Law Number 43 of 1999 on the Reform of Civil State, Act No. 43 of 1999 concerning amendments to the Law No. 8 of 1974 on Discipline of Civil Servants (PNS). However, in its application of the law can not stand alone, because the law is also associated with other regulations that discuss the same issue, namely Regulation No. 32 of 1979, Government Regulation No. 30 Year 1980 and Government Regulation No. 37 of 2004. dismissal of Civil Servants (PNS) as a member of a political party must follow the procedures as stipulated in Law No. 32 of 1979, PP 1980, and PP No. 37 Year 2004 Regulation on remedies for Civil Servants (PNS), which dismissed the stipulated in Government Regulation No. 32 Year 1979 and Government Regulation No. 30 Year 1980.
