REVIEW ON LAW NO. 1 OF 2011 ON FLAT HOUSING IN PROVIDING THE LIVABLE RESIDENCE FOR LOW-INCOME COMMUNITIES

 

 

Indonesia's national development aimed to create a just and prosperous society based on Pancasila and the Constitution of 1945. The equity an prosperous society is defined not only enough of food, clothing, and shelter. Moreover, it should be interpreted as a democratic way to decide the future and collective participation to achieve the national goals. The spirit of nationalism in achieving the national goals is mandate and preamble of the 1945 Constitution which stated that every citizens is entitled to live in prosperity, both physical and spiritual, reside, and live in good and healthy environment. Residence has a strategic role in the formation of character and personality as well as one of the nation's efforts to build the citizen wellness, independent, and productive. Therefore, the government is responsible for ensuring the fulfillment of the appropriate and affordable residence. In achieving the residence demand, the state passed the Law No. 20 in 2011 on Flats regulation. The emergence of this law based on the instruction of Article 46 of Law No. 1 of 2011 on Housing and Settlement Area which provides that the provisions of the flats are regulated by law.

The purpose of this study are: To recognize the legal basis and the benefit of flats, as well as the concept and classification of residential housing and government programs in implementation of the housing and livable neighborhoods. To figure out the Criteria and Terms of Prospective Residents for Housing, Implementation of The Livable Settlements and Housing that related to Bank Guarantee after enactment of Act No.20 of 2011; to recognize the government steps in resolving the barrier of housing project program.

Data was collected by library research method. The study was conducted by review the library materials which knows as secondary data. It’s derived from various books and publication, government and legislation documents, both printed material and electronic.

By issued of Act No.20 of 2011 in lieu of Law No.16 of 1985 concerning flats, theoretically, the government has falicitated the regulation to provide the livable housing for low-income communities. In fact, this regulation has not fully practiced, because many people reluctant for the government’s housing program. The public determine that the residence is not livable, due to the poor of infrastructure and feasibility.
