ABSTRACT

THE LEGAL POSITION OF PAYROLL BOARD IN DETERMINING THE PROVINCIAL MINIMUM WAGE (UMP) AND REGENCY/CITY MINIMUM WAGE ( UMK) RELATED TO THE REGULATION OF LABOR AFFAIR AND TRANSMIGRATION MINISTER NO.13 OF 2012 CONCERNING TO COMPONENT AND IMPLEMENTATION OF THE ACHIEVEMENT OF PROPER LIVING NEED

The determining of minimum wage is an obliged step in each year for each local area. Payroll has an important role in this determining process. The formulation of minimum wage refer to the regulation of the proper living need. This is a part of task, function and authority of the Payroll Board and the objective of the estasblishment of this board. The role of Payroll Board in the determining of minimum wage is not speerated on its existence either in provincial or in regency. City level that did not as mentioned in the Presidential Decree No. 107 of 2004. The institution that believe will accommodate the threeparties in labor affair is dominated by government and its interest. The ambiguity of the existence of this Payroll Board to be a reason of the writing of this thesis. Therefore the objective of the writing of this thesis is to study the process of determining of minimum wage either Provincial Minimum Age (UMP) or Regency/City Minimum Wage (UMK), the legal position of Payroll Board in determining of minimum wage based on the proper living need.

The method applied in this research is juridic normative method by do the library research although this research is not seperated from other source in addition to the library research.

Payroll Board in formulate the minimum wage policy refer to the proper living need that had be determined. The legal position of this institution must be indicated to enable the implementation of minimum age as mentioned in its rule. The minimum age forl labor will realized without neglect the hope of employer.
